Sales Machine provides a suite of marketing automation tools including but not limited to:

  • AI-powered content generation for social media posts
  • Content scheduling and publishing across multiple social media platforms

  • Team collaboration and organization management
  • Integration with third-party social media platforms and services

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service
  • Use any robot, spider, or other automatic device or process to access the Service for any purpose
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission

5. Content and Intellectual Property

You retain ownership of any content you create, upload, or post through the Service ("Your Content"). By submitting Your Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute Your Content solely for the purpose of providing and improving the Service.

7. Subscription and Payment

Certain features of the Service may be provided for a fee. If you choose to subscribe to a paid plan:

  • You agree to pay all fees associated with your subscription plan
  • Fees are billed in advance on a monthly or annual basis, as selected
  • All fees are non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days' notice
  • If payment is not received, we may suspend or terminate your access to the Service

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will continue to have access to paid features until that time.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at support@the-salesmachine.com. Upon termination, all data associated with your account may be deleted in accordance with our Privacy Policy. We are not liable for any loss or damage resulting from termination of your account.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of its correctness, accuracy, reliability, or otherwise.

10. Limitation of Liability

IN NO EVENT SHALL SALES MACHINE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

Our total liability to you for all claims arising from or related to the use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless Sales Machine and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party right, including without limitation any intellectual property or privacy right.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sales Machine operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
